Mediation
For those of you unfamiliar with mediation, it is a voluntary and confidential negotiation process through which parties reach an informed agreement with the assistance of an impartial mediator. Mediation is generally a quicker and less costly alternative to divorce and post divorce litigation, so it is an attractive option for many couples. Mediation also makes tremendous sense for unmarried couples with children or intertwined assets and expenses who seek a reasonable way to end their relationship, develop a parenting plan and separate their assets.
As attorneys who routinely practice in the Probate and Family Courts, we are well versed in the law and the practical realities that establish the parameters of a reasonable settlement. We also understand the many non-legal issues that often impede settlement. It is our experience that through mediation, the parties have the opportunity to identify and address both legal and personal issues. By accurately identifying each party’s concerns and developing reasonable and workable options to meet those concerns, the parties are able to reach long lasting agreements.
